Privacy Policy
This policy explains what information Upcoat Painting collects through upcoatpainting.com, how we use it, and the choices you have. We try to keep it simple.
Who we are
Upcoat Painting ("Upcoat," "we," "us") is a small residential painting company based in Cypress, Texas, serving the Greater Houston area. You can call or text us at (346) 634-9441.
Information we collect
What you give us. When you request a free estimate, our form asks for:
- Your name
- Your phone number
- Your ZIP code
- The type of project
- Your preferred language (English or Arabic)
- Your email address (optional)
- A message (optional)
- Whether you agree to receive text messages (optional checkbox, unchecked by default)
If you call or email us, we also keep what you tell us so we can follow up and give you an estimate.
What is collected automatically. When you visit the site, our website host and any analytics tools we use may collect technical information such as your IP address, browser and device type, language setting, pages viewed, how long you stayed, the page that referred you, and your approximate location (city or region). This is often collected through cookies and similar technologies.
We do not ask for payment card details or Social Security numbers on this site. Please do not put them in the message box.
How we use your information
We use your information to:
- Contact you about your estimate and schedule a visit
- Answer your questions and provide our services
- Communicate with you in your preferred language
- Send text messages, only if you agreed to them
- Understand how the site is used and improve it
- Keep the site secure and prevent spam or abuse
- Measure and improve our advertising, if we run ads

Text messages (SMS)
On the estimate form, you may check a box to agree to receive text messages from Upcoat. Here is how that works:
- Consent is optional. You do not have to agree to texts to get an estimate. Not checking the box will not affect your estimate or our services.
- What we send. If you agree, we may text you about your estimate, appointment scheduling, reminders, and follow-ups about your project.
- Frequency. Message frequency varies.
- Cost. Message and data rates may apply, depending on your mobile plan.
- Opt out. Reply STOP at any time to stop receiving texts. You may get one final message confirming that you are unsubscribed.
- Help. Reply HELP for help, or call (346) 634-9441.
- Your mobile information stays with us. We do not share your mobile phone number or text messaging consent with third parties for their marketing or promotional purposes. We may share it with service providers that help us send messages, such as our text messaging platform and carriers, only to deliver the messages.
- Carriers. Wireless carriers are not liable for delayed or undelivered messages.
How we share information
We do not sell your personal information. We share it only in these ways:
- Service providers. Companies that help us run the business and the site, such as our website host (Framer), form and email tools, text messaging providers, scheduling or customer management tools, and analytics providers. They may use your information only to provide services to us.
- Legal reasons. We may disclose information if required by law, a court order, or a government request, or to protect our rights, property, or safety, or that of others.
- Business transfer. If Upcoat is sold, merged, or transferred, your information may go to the new owner.
- With your permission. For anything else, we will ask you first.
Cookies and analytics
Cookies are small files stored on your device. Our site is built and hosted on Framer, which may use cookies and similar technologies to run the site and provide built-in analytics.
We may also use, now or later, other analytics and advertising tools, such as Google Analytics or Meta Pixel. These tools can collect information about your visit and may use cookies to measure traffic and the performance of our ads. The tools we use may change over time, and we may update this policy when they do.
How to opt out:
- Change your browser settings to block or delete cookies. Some parts of the site may not work as well if you do.
- Turn on a privacy signal such as Global Privacy Control in your browser. We treat it as a request to opt out of targeted advertising and the sale or sharing of data where the law requires.

How long we keep information
We keep estimate requests and customer records for as long as we need them to serve you, handle follow-up and warranty questions, meet tax, accounting, and legal duties, and resolve disputes. If we do not hear from you or do not do business together, we generally delete or anonymize estimate requests within a reasonable time, typically within two years. Analytics data is kept according to each provider's settings.
Security
We use reasonable steps to protect your information, including secure (HTTPS) connections and access limits. No website or system is completely secure, so we cannot guarantee absolute security.
Children
Our site is meant for adults who own or manage property. It is not directed to children under 13, and we do not knowingly collect information from them. If you think a child has sent us information, contact us and we will delete it.
Your choices and rights
You can contact us at any time to:
- Ask what personal information we have about you
- Correct information that is wrong
- Ask us to delete your information
- Stop text messages (reply STOP) or marketing emails (use the unsubscribe link or ask us)
Texas residents. The Texas Data Privacy and Security Act gives Texas residents certain rights over their personal data, including the right to know, access, correct, delete, get a copy of, and opt out of targeted advertising, sale, and profiling. Some businesses, including certain small businesses, are exempt from parts of this law. Whether or not the law applies to us, we will make a good faith effort to honor reasonable requests. We do not sell personal data, and we will not sell sensitive personal data without your consent.
To make a request, call or text (346) 634-9441. We may need to confirm who you are first. We will respond within 45 days, and if we deny a request, you can ask us to review that decision. If you are still not satisfied, you may contact the Texas Attorney General.

These terms apply to your use of upcoatpainting.com (the "Site"), which is operated by Upcoat Painting ("Upcoat," "we," "us"). Please read them.
Accepting these terms
By using the Site, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site.
The Site is for information only
The Site gives general information about our painting services. Descriptions, photos, price ranges, timelines, and anything an online form or a phone call suggests are for information only.
Estimates are not binding. Nothing on the Site, and no quote or estimate we give by phone, text, email, or form, is a contract or a guaranteed price until you and Upcoat both sign a written estimate or agreement. Final price and scope depend on an in person look at the project and may change if conditions change.
Warranty. The Site does not create a warranty. If a warranty applies to your project, it will be described in your signed written estimate or agreement.
Using the Site
You agree to use the Site only for lawful purposes. You agree not to:
- Give false or misleading information, or use someone else's identity
- Submit spam, junk requests, or anything harmful or unlawful
- Try to break, overload, scrape, or gain unauthorized access to the Site or its systems
- Use the Site in a way that harms Upcoat or others
We may block access or remove content at any time if we think these rules are broken.
Intellectual property
The Site and everything on it, including text, photos, logos, the Upcoat Painting name, layout, and design, belongs to Upcoat or its licensors and is protected by law. You may view the Site and print pages for your personal use. You may not copy, sell, or reuse our content for other purposes without our written permission.
What you send us
When you submit an estimate request, message, photo, or other content, you promise that the information is accurate and that you have the right to share it. You give us permission to use it to respond to you and to provide our services. How we handle personal information is explained in our Privacy Policy. Please do not send sensitive information such as payment card or Social Security numbers through the Site.
Third party links
The Site may link to other websites or tools run by others. We do not control them and are not responsible for their content, services, or policies. Using them is at your own risk.
Disclaimer
The Site and its content are provided "as is" and "as available," without promises of any kind, express or implied. We do not promise that the Site will always be available, error free, or secure, or that the information on it is complete or up to date. Colors shown on screens may look different from real paint.
Limitation of liability
To the fullest extent the law allows, Upcoat and its owners, employees, and contractors are not liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of, or inability to use, the Site. Our total liability for any claim related to the Site is limited to $100.
This section applies only to use of the Site. It does not change the terms of any written agreement for painting work, and it does not limit liability that cannot be limited under Texas law.
Indemnity
You agree to defend and hold Upcoat harmless from claims, losses, and costs (including reasonable attorney's fees) that come from your misuse of the Site, your violation of these terms, or content you submit that you had no right to share.
Governing law and venue
These terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute about these terms or the Site will be brought in the state or federal courts located in Harris County, Texas, and you agree to that venue and jurisdiction.
Translations
The Site is available in English and Arabic. The Arabic version is provided for convenience. If there is any difference between the two, the English version controls.
Changes to these terms
We may update these terms from time to time. The effective date above shows when they last changed. Continuing to use the Site after a change means you accept the updated terms.

Accessibility Statement
Upcoat Painting wants everyone to be able to use our website, including people with disabilities. If you have trouble with any part of the Site, we want to hear about it.
Our goal
We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.2, Level AA. This is our target. We are a small business and are still improving, so we cannot promise every page fully meets it today.
What we do
- Use clear headings and a logical page order
- Aim for readable text sizes and strong color contrast
- Make the estimate form usable with a keyboard, with labeled fields
- Add text descriptions (alt text) to meaningful images
- Offer the Site in English and Arabic, including right to left layout for Arabic
- Make the Site work on phones, tablets, and computers
Known limitations
We know about some issues and are working on them:
- Some Arabic pages may not yet read as smoothly with screen readers as the English pages, or may have small layout problems.
- Some images, galleries, or animations may lack complete descriptions or controls.
- Third party tools on the Site, such as embedded forms, maps, or videos, may not be fully accessible, and we do not control them.
- The Site is built on Framer, and some built in components may have limits we cannot fully change.
